Welcome to HireSMMs (the “Platform”, “we”, “us”, “our”). These Terms & Conditions (“Terms”) govern your access to and use of our website at hiresmms.com (and any related services, features, tools) (collectively, the “Site”). By accessing or using the Site you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must stop using the Site immediately.

1. Definitions

“User” or “You” means any individual or entity who accesses or uses the Site, including job-seekers (“Candidates”) and employers/organisations (“Employers”).

“Employer” means any person, company or organisation posting job listings, recruiting, hiring or using the Platform.

“Candidate” means any person using the Platform to search for job opportunities, apply for jobs, create a profile, upload résumé, or otherwise engage as a job-seeker.

“Services” means the services we provide via the Site: job posting, job search, matching, profile listing, application processing, etc.

“Content” means any text, images, graphics, job listings, profiles, data, tools, forms or other materials on the Site.

2. Eligibility & Account Registration

To use the Site you must be at least the age of majority in your jurisdiction, and have capacity to enter into a binding agreement.

You agree to provide true, accurate, current and complete information when you register or use the Site (including your résumé/profile if you are a Candidate, or your organisation details if you are an Employer).

You are responsible for maintaining the confidentiality of your account credentials (username/password) and for all activities that occur under your account.

We reserve the right to refuse registration, suspend or terminate accounts at our discretion, without liability to you.

3. Use of the Site & Services

The Platform is provided to facilitate connection between Employers and Candidates. We do not guarantee that Candidates will secure a job, or that Employers will hire a Candidate.

Employers are solely responsible for assessing Candidates, making offers, entering into employment contracts or agreements, and complying with applicable labour laws.

Candidates are responsible for verifying Employer details, the legitimacy of job listings, and for deciding whether to apply.

You agree to use the Site only for lawful purposes, and in a manner consistent with these Terms, all applicable laws and regulations, and any reasonable instructions we issue.

4. Prohibited Conduct

You must not:

Post, upload or transmit any content which is unlawful, defamatory, fraudulent, obscene, offensive, discriminatory, or infringes intellectual property or other rights of others.

Use any robot, spider, scraper, data-mining tool or other automated means to access, monitor or copy any part of the Site.

Interfere with the operation of the Site or any feature thereof (e.g., hacking, introducing viruses, or security breaches).

Collect or store personal data about other users in a way not expressly permitted by the Site.

Impersonate any person or entity or misrepresent your affiliation with any person or entity.

5. Job Listings & Applications

Employers represent and warrant that job listings they post are genuine, accurate, legal, and comply with all applicable laws (including anti-discrimination laws).

Candidates represent that the information they submit (résumé, profile data) is truthful and accurate to the best of their knowledge.

We are not responsible for verifying the truth, accuracy or completeness of any job listing, Candidate profile, or employer information.

Candidates should exercise due diligence before entering into any employment arrangement. We disclaim any liability for reputational, financial or other loss arising from such arrangements.

6. Fees & Payment (if applicable)

If any part of the Platform is provided on a paid basis (for example premium job listings, featured Candidates, advertising, etc.), the fees, payment terms, refund policy and other terms will be as set out on the Site or in a separate agreement.

Unless otherwise stated, fees paid are non-refundable.

We reserve the right to change our fees at any time; changes will apply prospectively.

7. Intellectual Property

All intellectual property rights in or to the Site and Content (including design, text, graphics, software, logos) are owned by us or our licensors.

You may view, download or print pages for your personal non-commercial use only, subject to these Terms.

You may not reproduce, modify, distribute, sell, publish, transmit or create derivative works from the Site or Content without our prior written consent.

8. Disclaimers & Limitation of Liability

The Site and Services are provided “as is” and “as available”, without warranties of any kind, whether express or implied. We do not warrant that the Site will be uninterrupted, error-free or secure.

To the maximum extent permitted by law, we disclaim all warranties including merchantability, fitness for a particular purpose, non-infringement, accuracy of information.

In no event will we, our affiliates or our licensors be liable for any indirect, incidental, special, consequential or punitive damages (including loss of profits, data, goodwill, business interruption) arising from or related to your use of the Site, services, or any job result, even if we have been advised of the possibility of such damages.

Some jurisdictions do not allow the exclusion or limitation of certain liabilities, so some of the above limitations may not apply to you.

9. Termination & Suspension

We may suspend or terminate your access to the Site or your account immediately and without notice if you violate these Terms or if we reasonably suspect you have done so.

Upon termination, your rights to use the Site will cease immediately. Provision of services already in progress may be ended.

Provisions which by their nature should survive termination (e.g., limitations of liability, intellectual property, governing law) will continue in force.

10. Changes to Terms

We reserve the right to modify, amend or update these Terms at any time. The revised Terms will be posted on the Site with an updated effective date.

Your continued use of the Site following posting of changes constitutes your acceptance of those changes. You should review these Terms periodically..

11. General Provisions

If any provision of these Terms is held to be invalid, illegal or unenforceable for any reason, that provision shall be severed and the remaining provisions shall continue in full force and effect.

These Terms constitute the entire agreement between you and us regarding your use of the Site, and supersede all prior or contemporaneous understandings.

The failure by us to enforce any right or provision of these Terms will not constitute a waiver of such right or provision.
